The Detachment Process

The path we are taking is permitted by the Alaska State Constitution,

delegated by Alaska Statute to be administered by the Local Boundary Commission,

and the specific processes and requirements are detailed in Alaska Administrative Code.

Petition Preparation

The Eaglexit Board has been drafting a detachment of Municipality of Anchorage (MOA) Assembly District 2 (AD2) and incorporation petition package inclusive of (3 AAC 110.420):

a Charter describing the total design of the new borough;
a Metes & Bounds Map showing the new borough borders;
a Transition Plan from the MOA to the CRB; and
a legal brief detailing the legal aspects of the detachment.

Filing the Petition

The petition is submitted to the LBC Staff. (3 AAC 110.420) The LBC Staff perform a technical review to see if the petition has all the required information. (3 AAC 110.440) If the petition is found to be complete, it is accepted for filing by the LBC. If the petition is found to be incomplete, it is returned to the petitioner with comments indicating the necessary changes and/or information.

Petitioner Public Review

The Petitioner extensively publishes, posts, and mails notices

that the petition has been accepted for filing and the public can submit comments on it. Individuals have at least 49 days to file responsive briefs and comments in favor of or opposition to the petition. (3 AAC 110.480 & 3 AAC 110.640) The Petitioner may file a reply brief in response to all responsive briefs and written comments. (3 AAC 110.490)

Local Boundary Committee (LBC) Staff Analysis

LBC staff will conduct a public meeting to address the petition. (3 AAC 110.520) LBC staff writes and distributes a preliminary report for public review. (3 AAC 110.530) The Public has at least 28 days to comment on the preliminary report. (3 AAC 110.530 & 3 AAC 110.640) The LBC staff writes and distributes the final report.

LBC Public Review

The Local Boundary Commissioners conduct a public hearing.

(3 AAC 110.550 & 3 AAC 110.560) The LBC holds a decisional meeting in which a verbal decision is issued followed by a subsequent written decision.

(3 AAC 110.570) LBC decision options are: (1) petition approved; (2) petition amended and/or conditionally approved; and (3) petition denied. The Petitioner is given an opportunity for reconsideration. (3 AAC 110.580)

Implementation

If the petition is approved or amended and approved, an election is ordered and administered. (3 AAC 110.600) ONLY RESIDENTS OF ASSEMBLY DISTRICT 2 ARE ELIGIBLE TO VOTE ON DETACHMENT.

Election results are certified and provided to the LBC staff. If approved by the voters and results are certified, the proposed boundary change becomes effective immediately.

Establishing the Chugach Regional Borough

If approved by the voters and certified, the new borough is effective immediately and the documents in the successful petition package are enacted. Assets and Liabilities are distributed accordingly between the Municipality of Anchorage and the Chugach Regional Borough. A new assembly and community councils are created and representatives elected. Contract for essential services are issued as necessary until our own services can be established as determined by the residents. Alaska Statute limits this phase to two years maximum.
